The Promoted Spot

From time to time we may offer the opportunity for eligible Independent Broadcasters to purchase time on a rotating "promoted" slot on the front page of the Platform in an effort to promote their streaming broadcast. The Promoted Spot concept, fees, and general rules are presented below in greater detail.

1. Concept. When offered, eligible Independent Broadcasters will be able to purchase a pre-selected duration of time to rotate in and out of a pre-selected "promoted" slot (e.g., the 9th slot on the front page of the Platform) with a "pool" of other qualifying, purchasing Independent Broadcasters.
2. Eligibility. Eligibility will be limited to Independent Broadcasters who: maintain an account on the Platform in good standing; are, during the time period the promotion is offered, online and offering a streaming broadcast; have enough tokens for the offered promotion and are able to spend them; and are not currently under any penalty related to an actual or suspected breach of the Terms.
3. "Promotion" Defined. As used herein, "promotion" shall refer to the time period selected by an Independent Broadcaster who elects to use the Promoted Spot feature of the Platform.
4. Duration. Each promotion shall run for a pre-selected duration of time (e.g., a period of 5 minutes) that begins once you click the "Promote Now" button and see the countdown timer appear on your screen (as described in greater detail below in No. 5) and ends when the countdown timer reaches zero.
5. Price. Eligible Independent Broadcasters will be charged Platform tokens to enter a promotion. The token price for each promotion will vary based on a number of factors, including the number of Independent Broadcasters requesting to be included in the promotion "pool" at that time. The price for a promotion may fluctuate (e.g., every minute) but will not fall below the minimum price of 50 tokens. However, once you click the "Promote Now" button and confirm your purchase, you will lock in the current price and duration for that promotion.
6. Procedure. When offered, a "Promote Now" button will appear on eligible Independent Broadcasters' screens that includes information about the offered promotion (i.e., the location of the promoted slot, the duration of time, and the price). Once you click the "Promote Now" button and then confirm your purchase, a countdown timer will appear, and you will begin rotating in the promoted slot with the other "pool" members and you will automatically be charged the stated number of tokens. There are no refunds. The promotion will end when the countdown timer reaches zero and you will be removed from the promoted slot. In the event that there are an insufficient number of eligible Independent Broadcasters for a promotion, we reserve the right to cancel the promotion, in our sole discretion. If a promotion you attempted to join is cancelled, you will not be charged.
7. Rotation Process. Each time a promotion begins, all members of the "pool" go through an automated rotation process that decides which Independent Broadcaster will appear first in the promoted slot and the order of the rotation. Every time a Community Member navigates to the Platform's front page during the promotion (including a page "reload"), the automated rotation process will restart with potentially different results each time. For example, while Independent Broadcaster "A" is currently being featured in the promoted slot for Community Member "1," it is possible that Community Member "2" sees Independent Broadcaster "B" (or another member of the "pool") in the promoted slot at that same exact moment. As such, since the order of the rotation will fluctuate based on when Community Members navigate to the front page of the Platform in relation to the amount of time remaining in a promotion, we cannot guarantee that each Community Member will see you in the promoted slot or see you for an equal amount of time.
